Terms of Service

These Terms of Service ("Terms") govern your use of the website at cardata.pro and the application at app.cardata.pro (together, the "Service", operated by "CarData Pro", "we", "us").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CarData Pro provides structured automotive market intelligence — vehicle specifications, pricing, and competitive positioning — for product, pricing, and competitive teams at OEMs, leasing providers, and dealer groups. Specific features and coverage are described on the Site and may change over time.

2. Eligibility

You may use the Service only if you are at least 16 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to do so on its behalf, and "you" in these Terms refers to that organization.

3. Accounts

Access to the App requires an account, which today is created by us on request. You are responsible for:

• Keeping your login credentials confidential.
• All activity that occurs under your account.
• Notifying us promptly at hello@cardata.pro if you suspect unauthorized use.

We may suspend or terminate accounts that violate these Terms or pose a security or legal risk.

4. Acceptable use

You agree not to:

• Use the Service to violate any law or third-party right.
• Scrape, harvest, or extract data from the Service except as expressly permitted by your subscription.
• Reverse engineer, decompile, or attempt to derive the source code or underlying data structures of the Service.
• Resell, sublicense, or commercially redistribute data obtained from the Service without our written agreement.
• Use the Service to develop a directly competing product.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or any associated systems.
• Use automated means (including bots and crawlers) to access the Service except where we provide an API or have otherwise agreed in writing.

We may investigate suspected violations and take action, including suspending or terminating access.

5. Intellectual property

The Service, including the underlying data, software, interfaces, design, and branding, is owned by CarData Pro and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service in accordance with your subscription and these Terms. Nothing in these Terms transfers any ownership rights to you.

Feedback you provide about the Service may be used by us without restriction or obligation.

6. Data

Your account and usage information is handled in accordance with our Privacy Policy. You retain any rights you have in the data you upload to the Service. You grant us a worldwide, non-exclusive licence to host, process, and display that data only as necessary to provide the Service to you.

7. Third-party services

The Service may link to or interoperate with third-party services. We are not responsible for third-party content, terms, or practices. Your use of any third-party service is at your own risk and governed by that service's terms.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, or that any defect will be corrected. While we work to verify accuracy, vehicle data is sourced from manufacturers and third parties and may contain errors, omissions, or delays. You are responsible for verifying any information from the Service before relying on it for business or legal decisions.

9. Limitation of liability

To the maximum extent permitted by law, CarData Pro and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amounts you paid to us for the Service in the twelve months preceding the event giving rise to the liability, or (b) €100.

10. Indemnification

You agree to defend, indemnify, and hold harmless CarData Pro from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.

11. Term and termination

These Terms apply for as long as you use the Service. We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms or for any other reason in our discretion. On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and governing law) will survive.

12. Changes

We may modify these Terms from time to time. When we do, we will revise the "Last updated" date at the top, and material changes will be announced on the Site. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of Portugal, without regard to conflict-of-law principles. The courts of Lisbon, Portugal will have exclusive jurisdiction over any dispute arising out of or related to these Terms, except that we may seek injunctive relief in any competent court.

If you are a consumer in the European Union, you also have the protection of mandatory consumer-protection laws in your country of residence, and nothing in these Terms removes those rights.

14. Miscellaneous

These Terms, together with the Privacy Policy and any subscription order or written agreement between you and CarData Pro, constitute the entire agreement between us regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
